Social Security Disability Insurance Attorney

When representing clients regarding eligibility of Social Security Disability Insurance, the Law Offices of John B. Martin deals with the government on your behalf in San Diego, CA.

Disability benefits are not immediately available to you the moment after you become disabled, but John B. Martin is ready to explain the Social Security disability process to you.

To be eligible for Social Security Disability Insurance (SSDI) benefits, you must demonstrate the following:

First, you must have worked for a certain amount of time before you became disabled.

SSDI candidates who do not meet this history of earnings threshold may only be eligible for Supplemental Security Income (SSI) benefits.

For candidates who meet this threshold, the dollar amount of your disability compensation depends in part on your history of earnings.

Second, your disability must meet the Social Security Administration's (SSA) definition of disability.

According to the Social Security Administration, you qualify for Social Security Disability Insurance only if:

  • You cannot do the work you did before you became disabled.
  • You cannot perform another job in your current medical condition.
  • Your doctor expects that your injury will last for at least one year or result in death.

Between the date of your disability's onset and the date when your disability benefits begin, you need to expect delays.

You are not entitled to SSDI payments for 6 months after the date of onset of your disability with Medicare payments beginning 30 months after the onset of your disability.

The program also limits eligibility based on your monthly earning capacity. I can explain the Social Security disability program to you in greater detail during a one-on-one initial consultation.

If you do not meet the requirements for Social Security Disability Insurance benefits, you may be eligible for Supplemental Security Income.
